Research on the Legal Safeguards for the National Food Security Risk Monitoring and Early Warning System

Abstract:The food security risk monitoringand early warning system serves as thevanguardand cornerstone for preventing and mitigating major risks,thereby fortifying the nation'ssecuritydefences.Presently,although China has establisheda preliminaryrisk monitoring network covering multiple stages,itsoverallefectiveness remains constrained by deep-seated institutional challnges.These challnges include ambiguous allocation of responsibilitiesamong entities,insufcient legal basis for monitoring standards,procedural botlenecks in information sharing,andthe dilution of responsibilities forearly warning responses.The fundamental issue lies in the absence of systematic legal safeguards.The Grain Security Guarantee Law of the People's Republic of China,which came into efect in 2024,explicitlyestablishesthe legal grain security monitoring and early warning systemin its dedicated chapteron "SupervisionandAdministration"(Article 59),providing fundamental guidance forthe system's legal construction.This study contends that there isan urgent need to drive a paradigm shift in risk warning from "administrative dominance"to "legal standardisation",and to establish a legal safeguarding frameworkcentredonthecoreprinciplesof "statutoryauthority,unifiedstandards,procedurallegitimacy,andclear accountability".Specific improvement pathways include: guidedbytheLawof thePenple's Republicof Chinaon Food Security Grain Security Guarantee Law, weaving a dense network of supporting regulations; legally defining and publiclydisclosing the listof responsibilities for risk monitoring,establishing an authoritative statutory coordination mechanism; establishing mandatory information-sharing protocols and standardised legal procedures for warning dissemination;and developingaclosed-loop legalaccountabilitysystem integratingadministrative responsibility with multi-stakeholderoversight.Strengthening legalsafeguards isan imperativechoice forenhancing the authority,scientific rigour,and public trustworthiness of the grain security risk governance system.
