Research on Balance Mechanism Between Evidentiary Validity Identification and Privacy Protection of Road Test Data of Automatic Driving

【Abstract】With thecontinuous development of automatic driving technology，road test data，asan important technical support means，hasshowngreat potential in traffcaccident judgment，responsibility atributionandtechnical optimization.However，asanew form of evidence，theidentificationof evidencevalidityand privacy protectionof automated driving road testdata have becomeacomplexsubject in law，technologyand ethics.This paper starts with the characteristicsof automaticdriving data，analyzes its evidential efectiveness in judicial practice，and discuses howto balance theprotectionof privacyand the identificationof evidence efectiveness intheprocess of using road testdata. Throughtheanalysisof the legal framework and thediscussion of technical means，a balance mechanism is proposed to ensure that theroad test dataof automatic driving can be usedas efectiveevidence under thepremise of protecting personal privacy，so as to promote the legal and compliant application of automatic driving technology.
