智能化农机装备的法律监管与伦理考量

Abstract：The largeamountofdatagenerated inthewidespreadaplicationof intellgent agriculturalmachineryand equipment in the development of modern agriculture involves sensitive information such as China’s agricultural production environment，crop growth status，andagricultural machinery operation status.Once these data are leakedorabused，it willcause incalculable lossesto China’sagriculturalproduction.Inaddition，theautonomousdecision-makingability ofintelligentagricultural machineryequipmenthas been significantlyenhanced，which canto someextent detach from direct human control and independently complete complex operational tasks.Once an accident occurs during the operationprocess，itisobviouslyunfair forthelegalresponsibilitytobebornebytheowner.Inresponseto the above issues，this papertakes theanalysisof thecurrentstatusof legal supervisionof intellgent agricultural machinery equipmentas thelogical starting point forresearch.Itanalyzes theproblemsexistingin the legal supervision of intellgentagricultural machineryequipmentfrom threeaspects：theformulationandimplementationof lawsand regulations，theresponsibitiesofregulatorydepartments，andtheinformatizationofagricultural machinery safety supervision.Furthermore，ethical considerations are made from the perspectives of data securityand privacy protection ofintelligentagricultural machineryequipment，biasanddiscriminationofartificialintellgencealgorithms，andthe legal subject qualificationof intellgentequipment.Onthis basis，four countermeasuresandsuggestionswere proposed to strengthen the formulationandupdating of laws andregulations，enhance data securityand privacy protection， strengthen thesupervisionandreviewofinteligentalgorithms，and improvethelegal statusandresponsibilityattriution of intelligent devices，for reference by local inteligent agricultural machineryand equipment regulatory authorities.
