-A Case Study of Diving at Tianjin Lion Forest Bridge

Abstract：Recently，asnewsofanelderlymandivingatTianjinLionForestBridgehasgoneviral，discusionsregardingthe applicationoftasumptoofiskinfolksportsactivishaveeeeigitedArticle76ofteCilCdeestabsesthpto ofriskforsposdalctivii，ispatietailaeboatdisssdiisincuatelyegis applicabilitytodversefolksportsijudisputes.Aalysssowstatapplyingteassmptioofisktofolksportsactiisivolvesthee elements：theojectiveelement，whicheferstoisksinherenttofolksportsactivities，thesubjectieelement，wereparticipatscan foreseeandacceptthersks，andthepreclusivecondition，whichdistinguishesbetween“intent，grossnegligence”and“ordinary negligence”.Whentheasumptionofriskisapliedtofolksportsactivities，theassumptionofriskshouldbebasedoadiertiation between cases that meet the doctrinal requirements and those that do not.
