On the Issue of Judicial Determination of Online Non-Contact Indecent Assault Against Minors

Abstract：OnlineindecentassultagainstminorsifictsgraveharmontheirphysicalandmentalhealthAlthoughChina’sjudicial interpretationhasprescribedstandardsfordeterminingsuchacts，thenonontactatureofonlineindecentassaultagainstmsill leavestheobjectiveboudaryofcoduct，sujectivepurpose，coercionandaggravatingcircumstancesunsetledinjudicialpracti.I judicialaplication，clarifingtebjectiebehavioralboundaryofonineindecentasaultagainstinors，specifingstandardsfor identifyingsubjectiveintentandcoercion，andrefiningthecriteriaforaggavatedcircumstancessuchas“gatheringacrowd”and “commiting the act in a public place”will provide practical guidance for handling such cases.
