Abstract：Interaofthedigitaleconomy，thereisasignificanttensiobetweenthemergenceofalargenumbrof technologicalachievementsandteeistinglegalprotetionsystem.Asaband-newintiativeoftepropetyightssstem，dataitelecualpoperty rightsaimtoflltexistigasinitelltualprotyproeionSceitsitrodution，thasevdattntionndprootioin manyprovinesnditis.Hwever，tedefiitionofdataintelltualpropertyrightsisotuifdatpresentandtherearedierecs inthetargetofdataintellctualpropertyrights，suchas“dataordatasets，”whethertheratingelementsshould include“algorithicallyprocessd，commerialluabledio-publicate.”Ihisgad，asdnegialintentionofted comparingthediferentconotationsofwords，dataintelectualproperyightscanbedefinedas：“Therightofterigtholdertothe datasetobtainedinacordancewithlawsandregulations，foredaccordingtocetainrules，ndhavigpracticalvalueandinteltal propertyatrbute.”Atteseidtvodeetioofataintelalpropetyghtsitisessystish similarwordssuchs“datapoperghtsigitalintelalpropeghtsnddataintellalpropertyhts”inprctioa toachieve the desired understanding of data intellectual propertyrights.
