Does“Essential Patent” Apply to All Standards？—Discussion on Patent Standardization and Standard Essential Patents

Abstract：Byanalyzingthe“public”and“private”atributesofstandardcopyrightandthe“private”atributesof patent propertyrights，thispaperdefines the principles，scopeandrequirementsofnational standards，sectoralstandards，local standards，asoiationsadardandenterprisestadardsinvolvedinpatents，expainsthemeaningofsadardeetialpatents， anddefines theconcepts ofstandard quasi-essential patentsand standard necessary patents.Itclarifies what patents involved instandardsareessentialpatents，hatpatentsinvolvedinstandardsarequasi-esetialpatents，ndhatpatentsivolvedin standardsarenecessarypatents.Italsoputs forwardsomepolicysuggestionsonsupplementingandimprovingessntialpatents ofsectoralandlocalstandards，aswellasanti-monopolyofstandardessentialpatents.Thisstudyhasconsiderableguidingvalue formore effectively encouraging patent standardizationand implementing more scientific management of standard essential patents.
