On the Legal Regulation of Detention Review in Entry-Exit Administration

Abstract:Detentionreviewisoneofthemeans forborderpolicetoimplementtheirmanagementduties，butthenature,function, administrativeprocedures，remedialchannels，andpoweroversightofthisbehaviorhavenotbeenclarfied.Thelegalframeworkfor exercisingpoliceadministrativeoercionhasteiplicationofpromotingtelegitimateexerciseofstatecoercioninteeraBasednthe principleofproportionalityndministratielawsystemforiplementigdetenonreviehaviorisstablisdIntesofsstanti conditions，tehelementsfsverityosibilityndrgencysouldbeompreesielyonsderedndtqurementsfaity andrationalityshouldbeadhered;intersofproceduralbehaviordiferentsenariossouldbonstructedtostablishueproe；in termsofremedialchanels，theintensityofjudicialreviewshouldbeenhanced，andtheadresesshouldbegiventherghttocooe remedial channels.Inthisway，asystemforentryandexitreviewcenteredontheprotectionof personalfredomcanbeestablished.
