Exploration on the Procedure of Personality Rights Injunction in China

Abstract：Article997oftheCivilCodestipulatestheprohibitionsystemof infringementofpersonalityrights，whichisamajor inovationinthefeldofprotectionofpersonaityigtsinCina.Tepurposeofteprobitioofifringementofpersonalityightsly focusesonthepreventioandprotetioofpersoaltigtsTeaplicationofthepobioonifringemntofpersoalityghtshae characteristicsofspeedandsimplicityTherefore，theprocedurefortheprohibitionofinfringementofpersonalityrightsshouldbe constructedbasedono-litigationlegalprinciplesidertmettheurgetedforprotectionofpersoalityightsInliaon proceduresforpersonalityrightsinjunctios，thereshouldbenopre-litigationprocedures，andtestandardofprofadoptedshoudnotbe higherthan tatinordinarylitigationprocedures.Inorder tobalancetherightsndinterestsofbthprties，amechanismforconverting personalityrightsinjunctionsfromnon-litigationprocedurestolitigationproceduresshouldbestablishedwhiletheighttoojectofthe respondent is granted，so that the personality rights injunctions procedures can be reasonably used.
