The Dilemma and Perfect Way of Protecting the Interests of the Beneficiaries of Testamentary Trust

Abstract：China’sTrust Law has not ben amended for more than 20years，and thetestamentary trust system needs more and more attention in the protectionof beneficiaries’rights and interests.In viewof theexisting problems suchasthedispute on theeffective timeof testamentarytrust beneficiaries＼`rights and interests protection，the obstacles inthetrustee'squalification，the ambiguity of property ownership，and the greaterrisk of trustee's power abuse，this paper further analyzes the causes of corresponding problems.It isalso proposed to further protect thelegitimaterightsandinterests of beneficiariesthrough furtherdeterminingtheeffective conditions ofitestamentarytrust，establishing the mechanismof appointing trustees oftestamentarytrust，determiningthe ownershipof property during testamentary trust，and improving the supervisionmechanismof testamentarytrust，soas to better carryout wealthinheritance and management.
