The Formation Mechanism of GBA Standards and Practical Pathways in Free Trade Zones from the Perspective of Institutional Openness

Abstract:This study examines the formation mechanismof the GBA Standards within the Guangdong-Hong KongMacao GreaterBayArea (GBA)andtheir implementationpathways inpilotfreetrade zones,basedontheperspectiveof institutional opening upand underthecontextof“onecountry,two systems,and threelegal jurisdictions".It proposesa "two-dimensionalcoordinationmechanism”—utilzingmutualrecognitionofstandards tomitigate jurisdictionalconflicts and adopting tiered governance toaddress theregulatory misalignment—andconstructsa thre-layer implementation framework comprising the“foundationsupportlayer,scenarioapplication layer,andrulealignmentlayer".Case studies of thedifferentiatedpracticesintheHengqin,Qianhai,Nansha,andHetaozonesdemonstratethattheGBAStandards efectivelyfacilitatethesoftconnectivityofrulesandinstitutionalinnovationintegration.Thestudyfurtheridentifies chalengesuchaspolicyimplementationgapsandimbalancesinstandardssupplyandpropossan“industry-standardssystem”inducedmodel.It providesareplicable paradigm forrulealignmentbothwithinthe GBAandforsimilarregions globally, which is of theoretical and practical significance for deepening institutional opening up.
