Research on the Paths for Cross-border Data Flow in Alignment with the CPTPP under the China-US Competition

Abstract：Recently，theChina-USrelations havedrawnwidespreadattention.TheComprehensiveandProgressive AgreementforTrans-PacificPartnership（CPTPP）isarepresentative“USsample’ininternationaleconomicandtraderules. In China’s2025 Government Work Report，itwas proposed that China should actively promote the processof joining the CPTPP，which hasbecome an important measure toreshape the world economic landscapeand poolinternational common strength.InApril225，theUnitedStatesofciallyimplementedanotherfederalregulationtargetedattheross-borderfow ofsensitivedata，directlyaffectingChina.Thisregulationindicatesthatthecross-borderdatafowhasbecomethenext aspectofChina-UScompetition.Therefore，thepapertakescross-borderdataflowastheresearch focus，andstudies the currnt highdatabariersinChinathroughtheDigitalServices TradeIndex（DSTRI），theDigitalTradeIndex（DRI，and legalsystemofcros-borderdatafow.Itclarifes thebasicsituationthatthereisstillalargedigitaldividewithmemberstates anditishinderedbytheunilateraldatagovernancesystemoftheUnitedStates.Tus，suggestionsareputforwardtoalign with the high-standard CPTPP digital trade rulesand counter the datablockade of the United States.
