屏蔽网站禁令制度的本土化构建研究

Abstract：Inrecent years，the number of websites engaged in piracyand infringement in China remains high. Theexistingregulatory means havesomedisadvantages，suchasinapplicabilityandeasytobeavoided，which isdifficulttocrack downonthem.Fromtheperspectiveofextraterritorialapplication，thewebsite shielding prohibitionsystemhas uniqueadvantages incombating network piracyandinfringement.Whatismorerare is that this measure can be connected with China's joint tort theory and act preservation system.Based on this，on the basisof not violating the existing copyright legislative framework，China can clearly specify theapplicableobjects of thewebsite shielding prohibition system，andput forwardthe applicableelements ofthesystemsuitablefor Chinaincombinationwiththenationalconditions，soas tobuildthelocalization of the system.
