On the Disposal of Rural Land Contract Management Rights in Personal Bankruptcy

Abstract:Although the personal bankruptcysystem in China has ben pilotedin Shenzhen,itis still inits infancy.If personalbankruptcyis implemented nationwideinthefuture,itwill inevitably face the problem ofhowtoconnect itwiththerurallandrights separationsystemin China.Inthisregard,the Personal Bankruptcy Law should start from the particularity of Chinese farmers,clarify that specific farmers should be thesubject of personal bankruptcy，denythe bankruptabilityofrural contract management households,and in ordertoensure the survivaland developmentof farmers，social stability，etc.,clarifythat farmers'relevant land rights should be included as the scope of exempted property，and the contract rights should be classifiedasexempted property，whilethe management rights should becomprehensively judged based onthe amount of property owned by farmersatthetime of bankruptcy，as well as the specific business situation of thebankrupt.
