Abstract：Thepaperaimstoclarifythenatureofwidelyusedtechnicalstandards whentheyareappliedat theleveloflawsand regulations，ndtoachievethepurposeofappyingtechnicalstandardsinlaw.Thepapercompares thediferencesinnature betweentechnicalstandardsandlegalnorms，toobservethespecificroleoftechnicalstandardsindiscretion.Theresultisthatin theprocesofdiscretion，technicalstandardhavevalueinresolvingdiferencesandambiguitiesinfactualuncertaintyconcepts inlegalnorms，especiallinthefeldofdiscretionoflegalprovisions.Therefore，technicalstandardscanbetransforedinto discretionbenchmarks foradministrativeactions.Internalizingtechnicaltandardsthatarediferentfromnormsandprinciples intodiscretionarybenchmarks thatare internallyconstructed bydetailedscenariosand standardizedefects notonlyprovides apath foradministrativeagencies toutilizetechnicalstandards，butalsosolestheproblemofinsuffcientresouresfornonpunitivediscretionarymeasuressuchasadministrative licensingandadministrativeexpropriation，providinganewinstitutional breakthrough in non-punitive discretionary benchmarks.
