Analysis of the Standardization of Personal Privacy Judgment in Government Information Disclosure

Abstract：Thedefinitionofpersonalprvacyingovermentinformationdisclosureisacrucialinkinbalancingcitizensrightto knowandtheirighttoprivacy.However，inpractice，thereareproblemssuchasambiguouslegalnors，lagingtechological governance，andimbalancedjudicialdisretion.Thispaperproposesathre-evelstandardizedpathforthejudgmentofpersonal privacyingovernment informationdisclosure：First，itclarifiesthemeaningofpersonalprivacythroughlegaldogmatics，and distinguishesprsonalpracyfromonceptssuchasprsonalformationndsnsitiveiformation;second，itexpandsthe extensiobydrawingonjudicialpracticeexperience，andsummarizesthecharacteristicsof privacysuchasrelativityand divisibilitytopromotesandardzation;thid，luejdgmentsaneapplididiidalasestoheeubstantiejustice emphasizingdueprocessandtheallcationofburdenofproof.Throughthestandardizationofpersonalprivacyjudgment，the three paths are expected to support the construction ofthe standardization system of open government information.
