Abstract：Generativeartificialintellgence（A）paintinghsdeveloedapidlyandbecomeidespreadbringingwithitteriskof copyrightinfringeentichsaroadsocialipact.TetchicalcharacteristicsofgenerativeAIpaintingicudedeepagapbilitiesandrelianceonmassiveamountsoftrainingdata.Combiningdomesticandinteratioaljudicialcases，copyightifrngentan bedividedintotwocategoris：infringementofexistingcopyightholdersbyrainigdataandinfringeentfacedbygeneratieAworks， suchasmisapropratioThreareanydiultisineprocessofgulatingopightinfringentcludingiguityinetei ningcopyrightoershipofgenerativeAworks，videntarydifcisinrainingdatainfringementcases，ndtelackofectivegov eranceftragdaesTtielyatergtdlaeoloaliovaiglatioiisd idetifyAIpaintingcopyghtsbasedontheorigialcontributiosofusers，exploretheuleofreversedburdnofproofinraningdatainfringement cases，and strengthen the governance of the source and content of training data.
