Research on the Copyrightability of AI-Generated Content

Abstract: [Purposes] The rapid development of artificial intelligence technology has given rise to a vast amount of AI-generated content.This content demonstrates significant potential in fields such as literature, art,and music,while simultaneously sparking debate over whether it constitutes a protectable work.In this context,this study aims to addressthe issue of the copyrightability of AI-generated content.[Methods] This study explores the copyrightability of AI-generated content by comparing legislation,policies,and judicial precedents across different jurisdictions,and by applying the fundamental theory of′works'underthe 'Copyright Law of the People's Republic of China' (hereinafter referred toas'Copyright Law') to argue for its copyrightability.[Findings]The U.S. Copyright Ofice holds anegative stance regarding the copyrightability of AIgenerated content; although the European Union lacks specific targeted policies,it posits that such content can only qualify for copyright protection if the user has made suficient creative contributions; China has not yetpassed legislation tomake clear provisions onthe copyrightabilityof content generated byartificial intelligence,and there are two distinct opposing views in the academic community.[Conclusions] Under the current framework of the Copyright Law,if the user has made personalized choices and arrangements during the creation process of the AI-generated content,which fully reflect their unique intellectual judgment and reasoning,causing the final output to meet the requirement of originality,then such generated content should fall within the scope of protection of the Copyright Law.
