Copyright Protection Problems and Solutions for Generative Artificial Intelligence

Abstract： [Purposes] This study aims to further improve the copyright protection system for generative AI in China，safeguard the rights and interests of copyright owners，foster innovation，and promote the sustainable development of the generative AI industry within legal and regulatory frameworks.[Methods] This paper analyzes the problems faced by generative artificial inteligence，including copyright subject identification，originalityassessment，infringementdetermination，andrightsprotection，andproposes targeted improvement suggestions.[Findings] China has not yet established a systematic legal framework for protecting AI-generated content，resulting in issues such as ambiguous copyright ownership，lack of specific standards fororiginality judgment，and practical dificulties in infringement identification.[Conclusions] To address these challenges，we recommend clarifying copyright ownership rules，refining originality evaluation criteria，and enhancing infringement prevention and rights protection mechanisms.
