Research on the Legal Issues of the Dispute Settlement Mechanism in the Energy Charter Treaty

Abstract：TheEnergyCharter Treatysignedin1994，formerlyknownastheEuropeanEnergyCharter，aims tointegratetheenergy systemsofRusiaandtheforerSovietrepublicsintothegbalenergsystm.TesigningoftenewInterationalEnergyCharterinMay 2015markedthetreaty’sentryintoth.Ora.einteatioalivesmentdisputeslementmchanismestablisdunderrticle26f theEnergyCharterTreatyipossrestrictiosonoststates，asdemonstratedbyarbitrationcasessuchasNykombv.Latvia，inwichhost statesfaceheavyfinancialburdensandrestrictionsonpolicyadjustent，afectingenergystructureotimizationandclimategoveane. Aproaches forimprovementincludeadinga“climategovernancepolicyexemptionclause”totheEnergyCharterTeatydefiningitasan “Carve-out”rterthanan“exeption”，ndaplyngtheexemptioclaustotheinteaioalinvesentdisputeselementhanism; enancingtheprofesioalolgeleveofbratosieinteatalivesentdspuestnteanstondatego erancedisputes；introducingan“Carveout’reviewproceduretobedecidedbytecompetentauthoritiesofthecontractingstatestough consultation;ifgntisacdtatersalleubidtoiteteabraiotribalcisiofichal bindthearbitralaloftntetioalisntdisteslhasbalagttestsfostatsdin vestors，and promoting the coordinated development of international energy investment and climate governance.
