EOD 模式下海洋生态保护项目建设的法律问题研究

Abstract：Building a strong maritime nation is an integral component and crucial strategic task for accelerating the advancement of Chinese modernization.With the deepening promotion of ecological civilization construction，the Ecology-Oriented Development（EOD） model， as an innovative approach to project organization and implementation，is grounded in the "Two Mountains" theory and provides a significant pathway for synergizing marine ecological protection with regional economic development. Based on the evolution of EOD policies and practical explorations in China，this study reviews the relevant laws and regulations pertaining to the construction of EOD一based marine ecological protection projects.Building on existing research，it identifies potential legal issues during project implementation，including compliance challenges and ambiguities in the boundaries and responsibilities of project participants. Corresponding recommendations are proposed，by introducing a“composite sea use"category，improving regulations related to marine ecological protection red lines，strengthening access mechanisms，and formulating specialized management measures for marine EOD projects. These suggestions aim to provide legal safeguards for the construction and sustainable development of marine ecological protection projects under the EOD model.
