Abstract：Thehigh-speed iterationof generativeartificial intelligence has once againtriggeredahot discussion onthe subjectificationof artificial intelligence.The“subject theory”is based on the expanded interpretationof thelegal subject，andadvocates the inclusion of special concepts suchas“limited subject"，“fictitious personality”and“electronic personality”into the category of legal subject.This view ignoresthestageof generativeartificialintelligenceinthecourseoftechnologicaldevelopment and the basicelements constitutingthelegal subject，andcannot belogicallyconsistent.Fromthe perspectiveof functionalism，“subjectificationlof generative artificial intelligence”causes the technical subject to violatesocialethics，aggravatethereversal ofsubjectandobjectandtheambiguityoflegalconcepts，thus hindering therealizationof the expected explicit function given to generative artificial intelligencele gal subject，and thus reaffirming the object attribute of generative artificial intelligence.
