Theldentification ofthe Fair Use of Portraits in NewsReports

Abstract：The provisions of thefair use of pontraits aimtobalance therelationship between personal portrait rights and social public interests.Fair use is the cause of illegal obstruction of portrait right infringement，suggesting thatithe portraitright holder claimsthattherights need tobetransferred tothe public interest，and the regulationof the useofthe user should belimiteditoa reasonablelimit.Identifying whether the use of portraits is a news report is a prerequisite for theapplication of Article 1020（2） ofthe Civil Code.Theidentificationof news reports should be based onthecontent，notlimitedtothe subjectof implementation.Theidentificationof thefair useof portraitsinnews reportsshould becomprehensivelyconsidered according to the specific circumstances from the legitimacy of purpose，the necessity of behavior and the rationality of use.
