Abstract:In practice,the reasons for acting under another‘sname to purchasea housearediverse,and the trial of cases involves the comparison and balance of interests among multiple parties.The core disputes presentedin disputes over nominal property purchases,such as theeffectiveness of the nominal contract, the ownershiplof the house,and the protectionof the interestsiof third parties,should not belimited to a purelyprivatelawdiscussion.Itis necessaryto comb the theoretical aspects of interest balancingin this dispute, Icomprehensive bubTi nterestofsociety,theprivateinterests ofeach interests Specificcri teriacanbe thepurchaseprice thede greeofsubjectiveaccountability whether thethirdparty isaware whetherthereisaitrustinvestment,and theactualcontrol statusof the house,coupledwithan examination of social interests toachieveabalanced protection of various interests,and to provide aninterpretive path for the principle ofithe statutory sys temofpropertyrights.
