Abstract：With therapid developmentof economic globalization，standardsare increasingly involving patents in the informationandcommunicationfield，andthecorrespondingdisputesoverstandardessential patents （SEPs）havegradually increased.SEPsarefully integratedwith theentire processofcommunicationevolutionandplayanireplaceablerole，which alsoimplycertaineconomicbeneftsforthecorrespondingpatentholders.Withthe freezeonthe3GPPRelease18standardfor 5G，itisexpectedthatteumberofsandardessentialpatentsfor5Gand6Gwillotinuetogowinefuture.Terefore howtodraftSEPsduringtheapplicationstageandhowto makedeterminationduring thedisputestage areofgreatsignificance fortheoperation and managementofSEPs by enterprises.This paper takes thecases of SEPs in disputes as the entry point. BasedontheanalysisoftheconceptandcharacteristicsofSEPs，itdeplystudies thegenerationprocessofSEPs，proposes specificjudgmentideasforSEPs，aswellasmethodstoimprovetheirstabilityandprovdessategicsggestionsforsto enterprises，assisting themin gaining the initiative in SEP disputes.
