Punitive Damages for Copyright Infringement by Short Video Platforms: An Interest-Balancing Perspective

Abstract: Following the introduction of the punitive damages system into the Copyright Law of the People's Republic of China,there is a tendency in judicial practice to apply punitive damages too broadly against short video platforms,thereby disrupting the balance of interests among rights holders, platforms,and users.In practice,this has weakened the safe harbor principle,blurred the doctrine of indirect infringement liability,and created excessive deterrence through punitive damages.From an interest-balancing perspective,the overly broad application of punitive damages for copyright infringement blurs the boundaries of liability for platforms as network service providers.This increase in regulatory burden encourages rights abuses and stifles creative dissemination,contradicting the goals of copyright law.Therefore,it is essential to accurately grasp the preventive goals of the system,correctly interpret its applicable requirements,and establish a diversified co-governance mechanism for both long and short videos to fulfillthe legislative purpose of copyright law: incentivizing cultural innovation and promoting the dissemination of quality works.
