Determining the Copyrightability of Video Game Rules

Abstract: Current judicial practice predominantly relies on the Anti-Unfair Competition Law to adjudicate cases involving video game rules. This approach,however, sidesteps the contentious issue of the copyrightability of video game rules,resulting in drawbacks such as excesive protection and the potential undermining of the Copyright Law.It is therefore necessary to address the protectability of video game rules under copyright law. From a semiotic perspective, the idea-expresson dichotomy does not preclude the copyrightability of game rules,as their primary function—providing mental satisfactionfallsoutside the realm of utilitarian functions excluded from copyright protection.In general, determining the copyrightability of video game rules should be assessed through a layered model based on the “abstraction-filtration method”. This involves distinguishing between foundational rules and specific rules,while holistically evaluating their expression and originality in relation to the requirement of perceptibility.
