Typification and Conceptualization: On Supervision System of Criminal Legal Aid

Abstract:CriminalLegalAid，asthemostcriticalcomponentof thelegalaidframework，directlyimpacts thefundamental rightsprotectionof criminal suspects anddefendants.Againstthebackgroundof thecontinuous rise inthe aplicationrate of desigated defense,improving the qualityofcriminal legal aid and perfecting thesupervision mechanism has becomean importanttopic inthestudyof criminal procedurejurisprudence.Grounded intheoriesof checksand balancesof power, humanrights protection，and equality between prosecutionand defense，theLegal Aid Law achieves institutional inovation through its dedicated thechapter ofsafeguards and supervision，establishinga regulatory framework that delineates responsible entities，standardizes funding audits，and implements servicequality evaluations.However，empirical evidence reveals functional deficiencies inboth socialsupervisionand judicialadministrativeoversightduring implementation, resulting ina paradoxicalcoexistenceof typologyandconceptualizationin practice.Thede-conceptualizationof thesystem of supervisionofcriminallegalaidshouldbeadvancedinasequencefromsocialsupervisiontosupervisionbytheadministrationof justice.Byclarifying thesubstantive scope of social supervision and its ancilary procedures，supplemeted by optimizig theprofessionalcompositionofjudicialadministrative personneland enhancingdata-driven statisticalanalysis， an objective evaluation system can be systematically developed.
