自动驾驶机动车交通事故侵权责任主体研究

摘 要：近年来，人工智能的热潮席卷全球，自动驾驶作为人工智能的标志性应用之一，毫无疑问将会带来巨大的社会效益。但是多起自动驾驶事故也警示我们应重视由自动驾驶机动车所引发的侵权问题。立足于自动驾驶的特性以及分级，来分析不同等级的自动驾驶机动车导致的交通事故中，损害赔偿责任主体的认定问题。

Research on the Subject of Tortious Liability for Autonomous Vehicle Traffic Accidents

Abstract：In recent years， the boom of artificial intelligence has swept the world， and autonomous driving， as one of the iconic applications of artificial intelligence， will undoubtedly bring huge social benefits. However， a number of autonomous driving accidents also warn us that we should pay attention to the infringement caused by autonomous vehicles. Based on the characteristics and classification of automatic driving， the article will analyze the identification of the subject of damage compensation liability in traffic accidents caused by different levels of autonomous vehicles.

1 自动驾驶机动车概述

1.1 自动驾驶机动车的概念及特性

根据《智能汽车创新发展战略》（征求意见稿），智能汽车是指通过搭载先进传感器、控制器、执行器等装置，运用信息互通、互联网、大数据、云计算、人工智能等新技术，具有部分或完全自动驾驶功能，由单纯交通运输工具逐步向智能移动空间转变的新一代汽车。（剩余4939字）
