Research on Infringement Issues of AI Face-Swapping Technology in Short Video Platforms

Abstract: [Purposes] This paper explores the copyright and portrait rights infringement issues caused by Artificial Intelligence (AI) face-swapping technology onshort video platforms in the context of artificial intelligence,analyzes the difficulties in infringement determination,and seeks feasible paths to balance individual interestsand public interests,providing new ideas for the parallel development of new technologies and the maintenance of social order.[Methods]By sorting outthe main application types of AI face-swapping technology on short video platforms,this paper analyzes the legal predicaments it faces in the determination of copyright and portrait rights infringement,and then puts forward corresponding regulatory suggestions. [Findings] As a typical application of generative artificial intelligence,AI faceswapping has problems such as difficulty in determining copyright infringement,diffculty in preserving the source of infringement,difficulty in determining the boundary of reasonable use of portrait rights, and the concurrence of portrait rights and copyright infringement.[Conclusions] Measures should be taken to clarify the primary responsibilities of online participants,define the accessrules for short video users, strengthen publicity regarding the potential infringement risks of AI face-swapping technology, and improve relevant legal regulations for the application of related technologies,so as to promote the healthy development of artificial inteligence technology within a reasonable and compliant framework.
