优化营商环境视域下行政检查之比例原则适用研究

Abstract： The rule of law is the best business environment. Administrative inspection，as an important system to further strengthen' market supervision in the context of the reform of "streamlining administration，delegating power，and improving services"，plays an important role in predicting business risk and guiding production in accordance with the law. However，in the process of administrative inspection，there has been a phenomenon of functional alienation，frequent law enforcement，selective law enforcement，and "one-size-fits-all" law enforcement methods. In order to further optimize the business environment and promote the standardization and legalization of administrative inspection，it is necessary to rely on the principle of proportionality to restrain the power of administrative inspection behavior from the four dimensions of legitimacy，appropriateness， necessity and balance of purposes， standardize the supervision and inspection behavior of law enforcement departments at allregions and levels，comprehensively rectify prominent problems in the field of administrative inspection involving enterprises，effectively protect the legitimate rights and interests of market operators，and ensure the administrative inspection system firmly on the track of the rule of law.
