AbstractTherulesfortheallcationofteburdenofproofinmedicalcaredamagedisputesdirectlyfecttheoutcomeofthejudgment andarecloselylatedteiterestsoftpartisIdicalaeamageliigaodingteurrtsubsativeled ofproofoftheperpetratorteresultoftedamagefultadthfctsoftecusalelatioshipisoebythpatient.Howeveueto thesubjectivityoffultfactsandtheompexprofesioalismofausalrelationsipspatintsfacedifiultiesinprovingfultadcausal factors.Inordertosolvetheaboveproblemsandreducethebrdenofproofonpatients，thispaperlocalzedthetheoryofapparenproof and thetheoryoflossofopportunity，and proposesamitigationshemefortheburdenofprofinmedicalcaredamagedisputes.
