Legal Dilemmas and Resolutions for Cross-Provincial Horizontal Ecological Compensation in the Xiangjiang-Zijiang River Basin

Abstract： As a significant institutional innovation in ecological governance， cross-provincial horiZontal ecological compensation addresses the implementation gaps inherent in traditional vertical ecological compensation mechanisms.Relevant departments in Hunan and Guangxi have jointly signed the “Memorandum on Jointly Establishing a Cross-Provincial Upstream-Downstream Horizontal Ecological Compensation Mechanism”to establish a cross-provincial horizontal ecological compensation mechanism for the Xiangjiang-Zijiang River Basin，initiating pilot projects characterized by inter-regional coordination and collaborative innovation.However，practical implementation faces legal issues，including ambiguouscriteria for determining liability across provincial sections and a lack of standardized evidence collection and evaluation systems. Moving forward，the two provinces should clarify the standards and pathways for determining liability，establish diversified funding and dispute resolution mechanisms，enhance cross-provincial enforcement coordination，and strengthen statutory frameworks for incentives and restraints. These steps will provide institutional safeguards for regional ecological securityand coordinated development while offering valuable insights for other river basins.
