Research on Infringement Liability and Governance Path of NFT Trading Platform

Abstract：As a new type of digital trading platform，NFT trading platforms promote the ownership and circulation of digital works within the scope of copyright while also raising prominent infringement issues.NFT trading platforms face three major challenges in the field of digital copyright protection： difficulties in identifying digital copyright infringers at the ownership level，the application of overly broad due diligence obligations on platforms at the liability level，and limitations due to the absence of platform transaction rules at the protection level. Based on factors such as platform type，control capacity， and economic benefits，the construction of platform infringement liability should center on the duty of care，strengthening the platform's pre一transaction review of NFT digital works copyrights. By combining a graded and categorized approach to quantify the platform's duty of care，the boundaries of NFT infringement liability can be clarified，and a corresponding regulatory framework established to promote the orderly development of the NFT trading market.
