Exploration and Analysis of the Copyright Law Protection for Contents Generated by Artificial Intelligence

Abstract: [Purposes] The high similarity between the appearance of the contents generated by the artificial intelligence and that of human works has raised issues concerning the protection under the copyright law.Therefore,it is necessary to clarify whetherartificial intelligence-generated content iscopyrightable and whether the copyright law can apply to thecontents generated by artificial inteligence for protection. [Methods] Through the analysis of relevant legal provisions,court decisions,expert opinions,policy reports and other materials,the reasons are discussed in depth. [Findings]At the stage of strong artificial intelligence,as the principlesand methods for content generated by generative artificial intelligence conflict with the existing system and logic of the copyright law,the copyright law cannot be applied to protect it at the current stage.[Conclusions] At this stage,it is suggested that the improper use of artificial intelligence-generated content beregulated through the Anti-Unfair Competition Law and effectively regulated and protected through the application of a compulsory registration system.
