胎儿不当出生侵权损害赔偿范围研究

——以31份民事判决为样本的实证分析

摘要：不当出生之诉，是指因医疗机构的诊断失实，提供错误的诊断资讯导致父母未能及时终止妊娠，因此父母向医方提起的索赔之诉。实质上侵害的是父母的优生、优育选择权，因此医疗机构应当对父母抚养缺陷子女所额外支付的费用进行赔偿，包括孕妇生产费、子女后续医疗费、特殊抚养费，以及精神损害抚慰金。

Research on the Scope of Compensation

for Infringement Damage Caused by Wrongful Birth of Fetuses

—An Empirical Analysis Based on 3l Civil Judgments

Abstract： The lawsuit of wrongful birth refers to the claim filed by the parents against the doctor for failing to terminate the pregnancy in time due to inaccurate or wrong diagnosis information provided by the medical institution. In essence， it infringes on the parents’ right to choose good birth and good upbringing. Therefore， medical institutions should compensate the parents for the extra expenses they have to pay for raising defective children， including the pregnant women’s production expenses， the subsequent children’s medical expenses， special maintenance fees， and the compensation for mental damage.
