从“形式”到“实质”:企业信用修复实证研究

Abstract:Enterprise credit repair is a core link in theconstruction of social credit rule of law.However,it has long being trapped ina stateof“formal compliance”,which fails to fundamentallyenhance corporate“substantive integrity’or effectively prevent the reoccurrence of untrustworthy behaviors after repair.This study selects 30 listed companieseachfromGuangdong,Anhui,SichuanandLiaoning provinces,representingtheeastern,central,western andnortheasternregionsofChina,assamples.Usingadiference-in-iferencesmethod,itanalyzes theimpactofredit repair oncorporate profitability and the frequency of untrustworthy behavior.The findings reveal that,while credit repair significantly improves corporate profitabilityit hasno statisticallsignificant effectonreducing the frequencyof untrustworthybehavior.Thisindicates thatanenterprise’stendencytowards“formalrepair"canunderminetheoverall fectivenessof the credit repair processGrounded inthe principleof proportionalityfromadministrative lawand the principle of good faith incivil law,this study proposedan institutional framework comprisinga“Thre-Dimensional Repair Benchmark"and a“Four-Level Repair System”.The aim is to establish a tripartite co-governance system involving“public authorities,technical platforms,and social entities”,thereby steering credit repair from“formal compliance" towards“substantive integrity”.
