Review of the legal issues and mechanism improvements in combating sexual harassment in higher education institutions in China

Abstract：Recently，several cases ofmale facultymembers'sexuallyharassing female students have come tolight， exposing many deficiencies in China’slegal framework foraddressing sexual harassment in Chinsesuniversities.The currentlegalmechanisms，primarilybasedonArticle10l0oftheCivilCodeofthePeople'sRepublicofChinaand supplementedbytherelevantprovisionsoftheLawofthePeople'sRepublicofChinaontheProtectionofRightsand InterestsofWomen，are insufficient toeffectivelycombat sexualharassmentoccurring between facultyand studentson campus.The shortcomings of thecurrent framework are mainlyreflected in threeaspects：regulations without supporting systems，rules without efective implementation，and punishments without corresponding remedies.Toaddress these shortcomings，Chinashouldadoptathreetieredlegalframework：enacting theLawonthePromotionofGenderEquality atthenationallevel，formulatingtheMeasuresforPreventingandHandlingSexualHarassmentinHigherEducation Institutions by the MinistryofEducation，and developing school-specific implementation guidelines to ensure a comprehensive legal framework that effectively prevents and addresses sexual harassment cases.
