Review of the legal issues and mechanism improvements in combating sexual harassment in higher education institutions in China

Abstract:Recently,several cases ofmale facultymembers'sexuallyharassing female students have come tolight, exposing many deficiencies in China’slegal framework foraddressing sexual harassment in Chinsesuniversities.The currentlegalmechanisms,primarilybasedonArticle10l0oftheCivilCodeofthePeople'sRepublicofChinaand supplementedbytherelevantprovisionsoftheLawofthePeople'sRepublicofChinaontheProtectionofRightsand InterestsofWomen,are insufficient toeffectivelycombat sexualharassmentoccurring between facultyand studentson campus.The shortcomings of thecurrent framework are mainlyreflected in threeaspects:regulations without supporting systems,rules without efective implementation,and punishments without corresponding remedies.Toaddress these shortcomings,Chinashouldadoptathreetieredlegalframework:enacting theLawonthePromotionofGenderEquality atthenationallevel,formulatingtheMeasuresforPreventingandHandlingSexualHarassmentinHigherEducation Institutions by the MinistryofEducation,and developing school-specific implementation guidelines to ensure a comprehensive legal framework that effectively prevents and addresses sexual harassment cases.
