Intellectual Property Protection Pathways and Enhancement Strategies forDerivative Data

Abstract: With the deepening development of the digital economy，the importance of derivative data as a new factor of production has become increasingly prominent. Derivative data refers to data products that are derived from raw data through in-depth mining， processing， and integrating by technical means，embodying intellctual labor. Its core characteristic lies in the condensation of substantial intellectual input and technical costs invested by data processors.Theoretically，there is a compatibility between derivative data and the object and institutional values of the intellectual property（IP） system，making it reasonable to incorporate derivative data into the IP protection framework. However，China’s current legal system faces significant institutional challenges in protecting derivative data. The existing IP laws cannot subsume derivative data， and applying the Anti-Unfair Competition Law to regulate infringements fails to provide proprietary protection,leading to an overreliance on general clauses.Therefore，within the existing institutional framework，the IP protection of derivative data requires the construction of a multi-layered pathway centered on a "works-neighboring rights" hierarchical system， supplemented by the Anti-Unfair Competition Law and supported by technical governance，so as to establish a contemporary data IP protection system that adapts to the digital economy era.
