Governance risksand benefit measurement norms of medicalartificial intelligence

Abstract: The report of the 2Oth National Congress of the Communist Party of China further outlined reform objectives,including“accelerating the construction of a digital China,”“promoting the construction of a healthy China,”and other areas.Medicalartificial inteligence（AI） is an important field for the deep integration of modern information technology and traditional industries.As the main body for governance and supervision of medical AI,the government’s effective governance is a crucial guarante foroptimizing the allocation of medical resources，achieving medical data sharing，standardizing inteligent diagnosis and treatment behaviors，and other aspects.However，the development scale of medical AI practices has far exceeded the existing regulatory framework，posing significant challenges to individual rights and public health that urgently require a response from the legal level. How to ensure the legitimacyof medical AI governance to prevent potential risks of medical AI and properly addressthe legal issues of AI application in the medical field have become common problems faced bycountries around the world，especially those with advanced information technologies.By introducing the benefit measurement norms into the legitimacy judgment of medical AI，a legal framework and operation rule system of medical AI govermance can be preliminarily constructed. Additionally，by leveraging the guiding role of core socialist values，improving procedural rules，clarifying the division of governance responsibilities，and other aspects,China contributes its wisdom and solutions to the lawful governance of medical AI.
