The Expansion of U. S. Extraterritorial Jurisdiction in the International Sports Domain and China's Response Strategies

Abstract：The expansionandabuseofacountry’s“extrateritorial jurisdiction”area highlycontentious isueinthe internationalarena.WiththeUnited States’invocationof“extrateritorialjurisdiction”intheFIFAcorruptioncaseandthe establishmentofextrateritorialjurisdictionoveranti-dopingissuesviateRodchenovAnt-DopingActthereisadisceible trendofrapidexpansionofU.S.extrateritorialjurisdictionwithintheinternational sportsfield.Theextensionofacountry's extrateitorial jurisdictionintointeationalsportsimpliesalegalbasisfortheinterventionoftatountry'sjudicialpower， which disruptsboththelongstandingtraditionofautonomyininternational sportsandtheprincipleof judicialdeferenceto internationalsportsafairs.Thisshiftcouldsignificantlyimpacttheentirelandscapeandtraditionalgovernaneofinteational sports.This papercombinesaliteraturereview withcomparativeanalysistoexaminethelegal foundation，typical cases，and risksassociatedwiththeexpansionof U.S.extrateritorialjurisdictionintheintemationalsportsfield，aswellasthe corespondingcountermeasures.ThestudyfindsthattheFIFAcorruptioncaserepresents the United States’initialaplication of itspre-existing extrateritorial jurisdictiontothesportsdomain.Incontrast，tejurisdictionestablishedbytheRodchenkov Anti-DopingActisspecificallydesigned forthesportsfield.Theexpansionof U.S.“extraterritorial jurisdiction”into the realmof sportsposeschalenges tothegovernanceof international sports，international sportsorganizations，andsovereign nations，includingChina.Itisnecessarytoaddress thesechalenges through multipleapproaches，suchasinterational cooperation and legal measures.
