Abstract： Legal enforcement against ofenses topublicsentiment has become increasinglycommon in practice.However， prevailingviewinlegalrationalismrejectspublicsentimentasalegitimatebjectoflegalprotection，particularlythroughcoercive measures，arguing that emotions are inherentlyvolatileandambiguous.Byclarifying theconcept of publicsentiment，this papercontends thatpublicsentimentisneitherirationalnorbeyondthereachoflegalenforcement.Rootedinspecifichistorical andsocialcontexts，publicsentimentplaysavitalroleinmaintainingsocialcohesionandpreservingculturalndhistoricalcontinuity.Legalenforcementcanbejustifiedwith necessryconstraints，whicharenotrigidboundariesbutapracticeorienteddemarcatio framework.This framework involves two mechansms，ontheonehand，adeliberativereflective-equilibriummechanismtodterminehichofnseswarrantlegalintervention，oneteradproportionalinterventionsanctiontirdh anism tocalibrate consequences for offenders，thereby establishing dynamic normativeboundaries in practice.
