创造性判断中改进动机与结合启示的考量

摘 要：本研究选取机械领域发明专利实质审查阶段的三个实务案例，探讨了发明创造性判断过程中最接近现有技术的改进动机对结合本领域公知常识的影响和对其他对比文件结合启示的影响，以及其他对比文件具有相反教导时结合启示的考量。对发明专利实质审查程序中，创造性的“三步法”的应用具有一定的参考意义。

Considerations of Improvement Motivation and Combination Revelation in Inventive Step

Abstract： This study selects three practical cases in the substantive examination stage of invention patents in the mechanical field， discussed the influence of the closest prior art's improvement motivation in the judging process of inventive step on the combination of common knowledge in the art， and the influence of the improvement motivation of the closest prior art on the combine revelation of other cited documents， and considerations of incorporation of revelation when other citeddocuments have contrary teachings. It has certain reference significance for the "three-step method" of Inventive Step in the substantive examination procedure of patents.
