Abstract： [Purposes]To clarify the rights protectionof digital achievements of intangible cultural heritage （hereinafter referred to as "ICH"）under the current copyright legal system，so as to promote the digitalization process of ICH and achieve the productive protection of ICH.[Methods] Starting from the concept of digital achievements of ICH，this paper analyzes the work attributes and rights ownership of such achievements，and then proposes solutions to the contradictions among various subjects based on the principle of rights balance.[Findings] Digital achievements of ICH can be classified into work-type and non-work-type according to the attributes of works.Work-type achievements can be protected by copyright， while non-work-type achievements fall within the scope of protection of neighbouring rights.[Conclusions] The rights protectionof digitalachievements of ICH requires the establishmentofan interactive rule of "full notification + substantive consent" and a benefit-sharing mechanism among rights subjects，and the construction of a rights balance mechanism through the supplementation of reasonable use rules，the addition of special licenses and shared licenses，and other statutory license scenarios.
