商标指示性使用问题概述

摘 要:商标指示性使用起源于美国的司法判例,并在实际运用中得到广泛认可。我国立法上对商标指示性使用没有明确规定,且理论研究较为薄弱。通过对商标指示性使用的概念进行界定,阐述这一制度的合理性及必要性,对这一制度在实际运用中所出现的问题进行分析总结,以期对此概念加以明确并运用到实际生活中。

Overview of Indicative Use of Trademarks

Abstract:Indicative use of trademark originated from judicial precedent in the United States and has been widely recognized in practice. There is no clear regulation on the indicative use of trademark in China's legislation, and the theoretical research is weak. By defining the concept of trademark indicative use, this paper expounds the rationality and necessity of this system, analyzes and summarizes the problems in the practical application of this system, in order to clarify this concept and apply it to practical life.
