摘 要：在史书关于匈奴和西域传记中，两汉与匈奴、西域诸国进行的和亲与人质政策贯穿于两汉的整个历史，因此，我们不妨将两汉的和亲和人质看成是一种被“制度化”的常规。本文依据史实，着重讨论这两种“制度”发生、发展及其背后可能的“法理”。

On He-qin and Hostage of Han Dynasty

Therefore we may consider them as an institution among Han dynasty ,Hun and Xi-yu. The author try to clarify what this institution happen, develop and its rules.

一、和亲：大国的惆怅
根据史书记载，匈奴和西域诸部落是北方的游牧民族，它们的生活习惯、法律习俗相近，但与主流的汉王朝差异巨大，比如《史记·匈奴列传》和《汉书·西域传》这样描述匈奴和乌孙国：
